Platform Code of Conduct

This Code of Conduct is an agreement between the User and TalentSprint. Every User who seeks access to the TalentSprint’s digital delivery platform, iPearl.ai (Platform), implemented for (“Partner Institute”) for delivery of its (“Program” / “Programme”) needs to adhere and comply with the policies prescribed in this Code of Conduct. This is in addition to other applicable Code of Conduct and Terms and Conditions that the User may have entered into with (“Partner Institute”). Non-adherence to this Code of Conduct will be looked into seriously and will be met with appropriate disciplinary action and may result in denial of Platform access to the User.

TalentSprint and the Institution regularly reviews their internal procedures and policies and as a result, the contents of this document may change from time to time. Without prejudice to any stipulation herein or except where specifically mentioned otherwise, TalentSprint and the Institution reserves the right to modify or terminate any of the policies described herein at its discretion by issuing a written notification of the change or by issuing an amendment to this Code of Conduct. Except where provided otherwise and without prejudice to any stipulation herein to the contrary, TalentSprint and the Institution reserves the right to make an exception to any of the contents in Code of Conduct.

Part A: Honor Code

• The User is expected to build a healthy and productive environment through their act of honesty, integrity, and respect in dealing with other Users and the faculty. Users are expected to conduct themselves in accordance with the guidelines of the Honor Code as it is an indication of the relationship between the Users and the faculty.
• Login credentials and all artefacts are strictly confidential to each User and the User must not share these with anyone. We do not permit any of the following:
  • Any other person sharing your login credentials;
  • Any part of the Platform being cached in proxy servers and accessed by individuals who have not registered with the Platform as a User; or
  • Access being made available to multiple users on a network;
  • Sale, trade, or transfer an account to another person, or using an account that is not originally yours.

  If you violate these conditions, your account will be terminated immediately.

• The User is expected to be respectful of one another and avoid any condescending and discriminative behavior. It is imperative that the Users show respect for every member of TalentSprint/Institution and refrain from any form of intimidation, harassment, and acts of prejudice that may infringe upon the rights of other users. Healthy competition is encouraged.
• Users are expected to hold themselves to high standards of discipline, tolerance, and respect. Users who violate the ideals and behavior expected of them will be subjected to disciplinary action.
• Users are not permitted to post repetitive, inappropriate, or promotional content on the Platform. If such content is found to be posted, TalentSprint/Institution reserves the right to immediately remove the same.
• Users are forbidden from submitting other Users’ work as their own, fabricating credentials, cheating on any tests, collaborating with each other in violation of the ideals imposed by the faculty.
• Any form of unlawful collaboration or fabrication of algorithms, code, or assignment solutions must be immediately reported to the respective faculty in charge. Users are strictly advised to avoid situations that may increase the likelihood of Honor Code violations.
• Users are bound to report any infraction of the Honor Code that comes to their attention. Users must NOT violate any of the Honor Code terms.
• Users are required to understand that any violation of this Honor Code, whether committed knowingly or out of ignorance, can result in disciplinary action. Violation of the Honor Code include but are not limited to the following:
  1. Access/Sharing of any prior/present batch user credentials,
  2. Replicate/duplicate/Copy from past or current Users examination paper,
  3. Permit/allow another User to copy from one's own paper,
  4. Unpermitted collaboration,
  5. Proxy Attendance,
  6. Plagiarism, revising and/or resubmitting a quiz or exam for re-grading, without the instructor's knowledge and consent,
  7. Provide or receive unpermitted aid on take-home examination.
  8. Represent the work of another as one's own work,
  9. Provide or receive aid on any academic assignment under circumstances in which a reasonable person should be aware that such aid was not permitted.

Part B: Terms of Use

• TalentSprint/Institution will provide the Users access to its online services and software for the specific purpose of this Program. The Terms of Use constitute the agreement between you and TalentSprint in relation to your use of the Platform. By using the Platform, you indicate your acknowledgement and acceptance of these Terms of Use.
• TalentSprint/Institution reserves the right to modify these Terms of Use at any time without notice, and such changes shall be deemed effective immediately upon posting of the modified Terms of Use on the Platform. Your continued use of the Platform following the notice of changes will be deemed acceptance to the changes. These Terms of Use will subsist until you continue to have access to the Platform.
• The User is strictly prohibited to use the Platform access for any commercial purposes. The services on the Platform are only for the use of registered users of the program.
• The User is solely responsible for the activity that occurs on his/her account. It is the User’s responsibility to keep any contact information, login credentials, or course work secure. TalentSprint is not responsible for any breach of information on your account.
• By signing this document, you consent to avoiding the following including but not limited to copying, commercial use or illegal distribution of any data available to your access. You are not permitted to access any restricted services or to intervene with the smooth functioning of the Platform.
• The User is solely responsible for the following content such as contact information, comments, questions, solutions posted on your account or anywhere on the Platform. TalentSprint/Institution reserves the right to permanently remove any content you share that it deems unfit.
• The User hereby also agrees not to post content that will cause harm or loss to other Users. The User is not permitted to post any contact information of others without prior consent or illegal content.
• The User agrees not to violate the rights and privacy of fellow users consequent to the content you share. TalentSprint/Institution is not responsible for the content shared by any User or any other user and is not responsible for any content you may come across that may insult, exploit, or injure you.
• All the services and resources provided by TalentSprint/Institution are legally available to access only for the Users registered for this Program. To the best of our knowledge any program material we use does not violate the rights of any third party. In case you find any such violation, please bring it to our notice to rectify the same. TalentSprint/Institution respects its user’s content and expects the users to also respect their and other user’s content.
• You agree that the Platform gives you access to proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use.
• You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works of the services, in any manner, and you shall not exploit the services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening the network.
• You further agree not to use the services in any manner to harass, abuse, stalk, bully, threaten, defame, impersonate, gamble, exhibit or transmit sexually explicit, pornographic, pedophilic content, promulgate hate speech, carry out illegal activities or otherwise infringe or violate the rights of any person (including other users and third parties, related or unrelated to the use of the services provided) including any patent, copyright, trademark, trade secret or other proprietary rights of such persons. You also agree that TalentSprint/Institution is not in any way responsible for any such use.
• All content on the Platform including videos are only for your use. Users are strictly prohibited from recording or sharing any of the program materials or details with any other person.
• When using the Platform, you shall not:
  1. Restrict or inhibit any other user from using or enjoying the services, including without limitation by means of hacking or defacing any portion of the services;
  2. Transmit any information that contains a virus, worm, time bomb, trojan horse or other harmful or disruptive component;
  3. Reproduce, duplicate, copy, sell, resell or exploit for any commercial or unlawful purposes, the content of the Platform or any portion thereof;
  4. Remove any copyright, trademark, or other proprietary rights notices contained on the Platform;
  5. Frame, mirror or link any part of the Platform;
  6. Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the services or to retrieve or index any portion of the services or collect information about users;
  7. Use the Platform for any illegal or unauthorized purpose.
• . All content made available in relation to the services including but not limited to any text, images, graphics, data, database, software, video and audio belong to TalentSprint/Institution or has been licensed to TalentSprint/Institution by third parties. Any use, including the reproduction, recording, downloading, modification, adaptation, distribution, translation, transmission, re-publication or in any other way exploitation of the services is strictly prohibited. The services are made available solely for your own personal, non-commercial and lawful use. Nothing provided in relation to the services should be considered as granting you, by implication, estoppel, or otherwise, any license or right to use any trademarks, logos, or other names without the expressed written consent of the applicable rights holder.
• TalentSprint/Institution reserves the right to append or remove features from any of the services provided. Your continued use of these services following the posting of changes will indicate your acceptance to those changes.
• The User shall ensure adequate and stable internet connection for effective learning on the Platform
• Users are encouraged to share their responses for the Platform/Program feedback that may be collected from time to time.

You expressly agree that in no event shall TalentSprint, the Institution, or any of its subsidiaries or affiliates be liable to you or any person for any direct, indirect, special, consequential or other damages (including, without limitation, any lost profits, business interruption, loss of information or programs or other data on your information handling system) that are related to the use of, or the inability to use, the services.
